Important: This Service uses artificial intelligence to generate analyses. AI outputs may be inaccurate, incomplete, or unsuitable for your situation. The Service does not provide professional advice of any kind. You are solely responsible for any decisions you make based on the results.
1. Agreement to Terms
By accessing or using Persona Portraitor ("the Service"), operated by Project Fifty4 ("we", "our", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
We reserve the right to modify these Terms at any time. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
2. Description of Service
Persona Portraitor is an AI-powered tool that analyzes conversation exports (such as WhatsApp chats) and generates insights about communication patterns, relationship dynamics, and conversational themes. The analysis is performed by Google's Gemini AI.
3. Eligibility
You must be at least 16 years old to use this Service. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
4. Account and Authentication
- You may access certain features by signing in with your Google account.
- You are responsible for maintaining the security of your account credentials.
- You must provide accurate information and keep it up to date.
- You may not use another person's account without permission.
5. Acceptable Use
You agree not to:
- Submit conversations without the consent of all participants (where required by law)
- Use the Service for any illegal purpose
- Attempt to circumvent any security measures
- Use the Service to harass, stalk, or harm others
- Submit content that is illegal, defamatory, or infringes on others' rights
- Use automated systems to access the Service excessively
- Reverse engineer or attempt to extract the underlying algorithms
6. Payment and Refunds
- The Service requires payment before analysis is performed.
- Prices are displayed before you confirm payment.
- Payments are processed by Stripe and are subject to Stripe's terms.
- Refunds: Due to the nature of AI-generated content, refunds are provided only if the Service completely fails to deliver any result. We do not provide refunds based on dissatisfaction with the quality or content of the AI-generated analysis.
7. Intellectual Property
- Your Content: You retain ownership of the conversation data you submit. By submitting content, you grant us a limited license to process it for the purpose of providing the Service.
- Generated Analysis: The AI-generated analysis provided to you may be used for your personal purposes. We do not claim ownership of these outputs.
- Our Service: All aspects of the Service, including its design, code, and branding, are owned by Project Fifty4 and protected by intellectual property laws.
8. AI Disclaimer and Limitations

The Service uses third-party artificial intelligence (Google Gemini) to generate analyses. You acknowledge and agree that:
- AI is not infallible: AI-generated content may contain errors, inaccuracies, biases, hallucinations, or misleading information.
- No guarantee of accuracy: We make no representations or warranties regarding the accuracy, completeness, reliability, or suitability of any AI-generated content.
- Third-party dependency: The Service depends on Google's Gemini AI. We have no control over Google's AI models, their training data, or their outputs.
- Outputs may vary: The same input may produce different results at different times.
- Not deterministic: AI outputs are probabilistic and cannot be predicted or guaranteed.
9. Not Professional Advice
THE SERVICE DOES NOT PROVIDE AND IS NOT A SUBSTITUTE FOR:

10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

- WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or goodwill
- Personal injury or emotional distress
- Decisions made based on AI-generated content
- Actions taken or not taken as a result of using the Service
- Relationship outcomes or interpersonal consequences
- Any harm arising from reliance on AI-generated analyses
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE THAT GAVE RISE TO THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless Project Fifty4, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you submit to the Service
- Any actions you take based on AI-generated analyses
12. Third-Party Services
The Service integrates with third-party services including:
- Google: For authentication and AI processing (Gemini)
- Stripe: For payment processing
Your use of these services is subject to their respective terms and policies. We are not responsible for the actions, content, or policies of these third parties.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination:
- Your right to use the Service ceases immediately
- We are not obligated to retain any of your data
- Sections that by their nature should survive termination will survive (including Limitation of Liability, Indemnification, and Governing Law)
14. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law. You agree to waive any right to participate in class actions.
15. Severability

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Project Fifty4 regarding the Service and supersede all prior agreements and understandings.
