Terms of Service

1. Agreement to these terms

By accessing or using Portraitor (the "Service"), operated by Project 54 ("we", "our", "us"), you agree to these Terms of Service. If you do not agree to them, you must not use the Service. We may update these Terms. Each version carries its own number and date, shown at the top of this page, and every previous version remains readable from the version history at the end of this page. Continuing to use the Service after a change means you accept the updated Terms.

2. What Portraitor is

Portraitor analyses a conversation export from a supported messaging application and generates a written portrait of a participant in that conversation: their communication patterns, attachment and conflict style, emotional regulation, and patterns of concern where the analysis finds them. The analysis is performed by a third-party artificial-intelligence provider, named in our Privacy Policy, on text from which identifying details have been removed on your device. The portrait is shown to you on screen, sent once to the email address you gave at checkout, and can be saved as a file produced on your device. We keep no copy of it and cannot reissue it if you lose it. The Service is built for reflection on your own relationships and is not designed to assess anyone for any other purpose.

3. Eligibility

You must be at least 16 years old to use Portraitor. By using it, you confirm you meet this requirement and have the legal capacity to accept these Terms.

4. Passes and guest use

You may purchase a single portrait as a guest, with no Pass or registration needed.

For repeat use, we issue a Pass, being a code that entitles the holder to a monthly allowance of portraits. A Pass is not an account. It is issued anonymously and is not associated with your name or email address.

You should be aware of the consequences of this. A Pass entitles whoever holds it to use it, and we have no means of verifying that the holder is the purchaser. If a Pass is lost or disclosed to a third party, we may be unable to establish that it belongs to you, and we accept no liability for portraits generated by any person in possession of it. Where a Pass is shared, its monthly allowance is shared with it.

You agree not to use another person's Pass without their authorisation, and not to resell or otherwise commercially exploit a Pass.

5. Acceptable use & consent

Portraitor is built for understanding yourself. You agree not to:

• Submit a conversation you do not have permission to analyse. Before payment you confirm that you have that permission. You are responsible for that confirmation being true: where the law of your country requires the consent of the other participants before their messages are analysed, you must have obtained it, and you must not submit a conversation that was obtained without the knowledge of the people in it.
• Use a portrait, or anything derived from one, to make or support a decision about a person's employment, education, housing, credit, insurance, immigration status, or access to any service or benefit. The Service is built for personal reflection and is not designed, tested or suitable for any such purpose.
• Use the Service to surveil, stalk, harass, or harm anyone.
• Use it for any unlawful purpose, or to submit illegal, defamatory, or infringing content.
• Circumvent security, reverse-engineer the Service, or extract the underlying models.
• Access the Service with automated systems in a way that overloads it.
• Access the Service through browser automation or scripted tools. The privacy protections that run on your device assume an ordinary browser, and we cannot guarantee them otherwise.

6. Payment

The Service is offered on two payment models, set out at 6.1 and 6.2 below. The applicable price is displayed before you confirm any purchase. All payments are processed by Stripe and are subject to Stripe's terms of service.

Prices are stated in United States dollars and are the same in every country. No tax is added at checkout. If your card is issued in another currency, your bank performs the conversion and may apply its own charges.

6.1 One-off portraits

A one-off purchase entitles you to a single portrait. Payment is taken in advance of generation. A one-off purchase does not recur, and we retain no payment method for future billing. If you purchase only one-off portraits, no further sum will be charged to you.

6.2 Monthly Pass recurring

A Pass is a recurring subscription that renews automatically until cancelled. By purchasing a Pass you authorise us to charge your payment method on the following basis:

• You will be charged $19 on purchase, and the same amount on the corresponding date of each subsequent month until the subscription is cancelled.
• Each renewal restores the Pass allowance to 10 portraits. Unused portraits expire at the end of the monthly period and do not carry forward.
• Renewal occurs automatically. You will not be asked to confirm each monthly charge.
• The current subscription price is displayed at the payment step before you subscribe. The price you subscribe at is the price your Pass keeps. A change to the published price applies to new Passes only. If we ever need to change the price of an existing Pass, we will write to the billing address held by our payment processor at least 30 days before the change takes effect, and you may cancel before it applies.
• If your allowance is used up before the renewal date, you may choose to refill it early. An early refill is charged at the same monthly amount, restores the full allowance immediately, and starts a new monthly period from that day, so your renewal date moves accordingly; the remainder of the previous period is not refunded. It is offered only when the allowance is empty and is never applied automatically. Where a Pass is shared, whoever refills it becomes the payer for its renewals from then on.

Cancellation. You may cancel at any time by opening your Pass from the Pass panel and selecting Cancel, or by writing to us at admin@portraitor.ai. Cancellation takes effect at the end of the monthly period for which you have already paid; your Pass remains usable until that date and will not renew thereafter. No cancellation fee applies and there is no minimum term.

When you cancel, we instruct our payment processor to remove your stored payment method. You may resume a cancelled Pass at no charge; your original renewal date and remaining allowance are preserved, and a card is collected again only when the next renewal falls due.

7. Refunds and cancellation rights

7.1 Your statutory right to cancel

If you are a consumer resident in the United Kingdom or the European Union, you ordinarily have a period of 14 days in which to cancel a contract for the supply of digital content and obtain a full refund.

Because a portrait is generated and supplied immediately, this right is lost once generation has begun. By confirming your order you expressly request that we begin performance immediately, and you acknowledge that you will lose your right to cancel in respect of that portrait once it has been generated.

Where you purchase a monthly Pass, the 14-day cancellation right applies to the subscription itself from the date of purchase. It is lost only in respect of portraits you have already generated during that period.

Nothing in this clause affects any other right or remedy available to you under applicable law.

7.2 Automatic refunds

If your portrait cannot be generated, or the on-device removal of identifying details cannot complete, nothing is transmitted and the charge is reversed automatically. You do not need to ask. For a Pass, the portrait is returned to your allowance instead.

8. Intellectual property

Your content: you keep ownership of the conversation you submit. You grant us a limited licence to process it solely to provide the Service. Your portrait: the analysis we return is yours to use for personal purposes; we claim no ownership of it. Our Service: the design, code, and branding of Portraitor belong to Project 54 and are protected by law.

10. Not professional advice

Portraitor is for reflection only. It is not a substitute for psychological, psychiatric, medical, legal, financial, or relationship counselling, diagnosis, or treatment. Do not rely on it for important life decisions.

If you are experiencing a mental health difficulty, a relationship crisis, or any situation where professional help is needed, please contact a qualified professional or your local emergency services.

11. Limitation of liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind. We are not liable for any indirect, incidental, special, or consequential damages, including loss of data, emotional distress, relationship outcomes, or decisions taken in reliance on a portrait. Our total liability will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Project 54 and its team from any claims, losses, or expenses (including legal fees) arising from your use of the Service, your breach of these Terms, your violation of anyone's rights, the content you submit, or actions you take based on a portrait.

13. Termination and availability

We may suspend or end your access without notice if you breach these Terms or use the Service unlawfully. If we end a Pass for any other reason, we will refund the unused part of the current month. On termination, your right to use the Service stops, and clauses that should survive (liability, indemnification, governing law) continue to apply.

We may take the Service offline for maintenance or in an emergency. Any purchase interrupted by this is refunded automatically under section 7.2.

14. Governing law & disputes

These Terms and any dispute arising out of or in connection with them are governed by the law of England and Wales, and the courts of England and Wales shall have jurisdiction.

If you are a consumer, this clause does not deprive you of the protection afforded to you by the mandatory provisions of the law of your country of residence, and you retain the right to bring proceedings in the courts of that country.

Before commencing proceedings, we ask that you contact us at admin@portraitor.ai so that we may attempt to resolve the matter directly. This is a request and not a precondition to any right you may have.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire agreement

These Terms, together with our Privacy Policy, are the entire agreement between you and Project 54 regarding the Service and replace any prior understandings.
